Mr. Gardner has an extensive courtroom experience in both criminal and civil litigation. He began his legal career in 1991, as a criminal defense attorney. He was a member of the Federal Criminal Justice Act Panel for the District of Utah as well as Conflicts Counsel for Legal Defenders of Utah. He has defended hundreds of cases ranging from simple misdemeanors to aggravated felonies including armed robbery and murder in both State and Federal courts. In 1999, he re-focused his practice when he became involved in foodborne illness litigation as an attorney for a client who had ended up in renal failure after eating eggs at a Nevada casino tainted with salmonella. In that case, he involved the Seattle firm of Marler Clark, who had become famous for suing Jack in the Box restaurants in its E. coli O157:H7 personal injury litigation. The settlement of the Nevada casino case resulted in the largest settlement in Utah history for a food poisoning case up until that time. Since that time, Mr. Gardner has been involved in foodborne illness litigation involving bacterial and viral agents in settings ranging from large scale outbreaks to individual cases. Most of these cases he associates with Marler Clark in Seattle. In addition to his work on food poisoning cases, Mr. Gardner handles general personal injury cases and medical malpractice cases.
Mr. Gardner has a Juris Doctor from Pepperdine University as well as a Masters of Business Administration from Westminster College. He taught as an adjunct professor at Westminster College from 1995 until 2000 and was awarded an outstanding professor award from there in 1995.
He has extensive experience in alternative dispute resolution, including mediation and arbitration and has attended the Straus Institute in Malibu, California for training in this area.
Mr. Gardner is also a professional jazz drummer and currently plays in the JD Moffat Quartet.
